中込伸打假球案 中職求償敗訴

兄弟象前日籍總教練中込伸，配合「雨刷」職棒賭博集團，帶頭打了5場假球，獲取150萬元不法利益，中華職棒聯盟提告求償2億1千萬元，不過最高法院認為，被害人是簽賭的賭徒，不是中職，昨天判決中職敗訴，全案定讞。

法院指出，雖然中職不能以詐欺案被害人身分求償，中職仍可另依其他方式向中込伸求償。

中込伸2008年至2009年間在兄弟象隊，先後擔任投手教練、總教練，配合綽號「雨刷」的蔡正宜職棒賭博集團，在中職比賽帶頭打了5場假球，獲得150萬元不法利益。本案刑事部分，台灣高等法院依詐欺罪，判處中込伸有期徒刑1年8月、緩刑4年，且須支付國庫180萬元公益金確定。
